There is a lady in my town who runs a small BBQ joint that keeps spamming Facebook, posting that she needs dishwashers and servers but is only paying $9/hour. Without fail, someone informs her that minimum wage in Minnesota is $10.08 for large employers. She always replies with "I'M A SMALL BUSINESS! MINIMUM WAGE IS LOWER FOR ME!" Needless to say, she hasn't found help yet.

Take the job, then sue her for underpayment...

Yeah no. She's legally correct. Her minimum wage is lower, but still doesn't mean she's going to find anyone who will work for her

OK! Im from the UK so didn't realise there were differences, I thought she was trying to get round the rules by saying she's a small business

It's ok. I don't think many people who live in the states know the differences either. In my state if your business makes less than $500,000/year you can legally pay a lower wage. Also, waitresses can be paid lower because they receive tips.

It would be similar to your tiered wage but instead of being based on age it's based on business size.
